1. Introduction
Brandimi LLC d/b/a MaviGadget (“MaviGadget,” “we,” “us,” or “our”) operates a multi-vendor marketplace platform that provides the technology infrastructure through which independent third-party sellers (“Sellers”) may offer products and services to consumers. The Services are built on and hosted by a third-party e-commerce platform infrastructure provider that independently processes certain data—including payment transactions, checkout information, and platform-level cookies—in accordance with its own terms and privacy practices. This Privacy Policy describes how personal information may be collected, used, disclosed, and processed when you access or interact with our website, applications, communications, and related services (collectively, the “Services”). As used in this Policy, “personal information” has the broadest meaning given to it under applicable law.
By using the Services, you acknowledge and agree to the practices described in this Policy. This Policy may be supplemented by additional notices provided at or before the point of collection. If you do not agree, please do not use the Services.
2. Information We May Collect
Information You Provide. When you create an account, place an order, contact us, or otherwise interact with the Services, you may provide information such as your name, email address, postal address, phone number, payment details, and related information.
Information Collected Automatically. When you access the Services, information may be collected automatically through cookies, pixels, web beacons, server logs, and similar technologies (collectively, “Tracking Technologies”), including device and browser information, IP address, browsing and interaction data, and information about how you use the Services. Certain Tracking Technologies are set and operated by our underlying e-commerce platform infrastructure provider and are outside of MaviGadget’s direct control.
Information from Other Sources. We may receive information about you from third-party partners, including advertising networks, data partners, analytics providers, and data enrichment services. Third-party partners may use Tracking Technologies on our Services and elsewhere to associate browsing activity with contact information or other identifiers maintained in their databases. As a result, we or our service providers may obtain contact information associated with a visit to the Services, including in cases where such information was not directly provided to us by the visitor.
3. How We May Use Information
We may use the information we collect to operate, maintain, and improve the Services; process transactions and communicate with you about them; send promotional and marketing communications where permitted by applicable law; personalize your experience and deliver relevant content and advertising; conduct analytics and research; detect and prevent fraud and other harmful activity; enforce our policies and agreements; comply with legal obligations; and for any other purpose disclosed at the time of collection or for which we obtain your consent.
4. How Information May Be Disclosed
Personal information may be disclosed to the following categories of recipients, as applicable:
• Sellers: Information necessary for order fulfillment, such as name, shipping address, and order details, may be disclosed to the applicable Seller. Upon receiving this information, the Seller becomes an independent data controller solely responsible for its handling of that information in accordance with its own privacy policy and applicable law. MaviGadget’s responsibility for personal information disclosed to a Seller ends upon delivery to the Seller.
• Service Providers: Information may be disclosed to providers that perform services on our behalf, including payment processing, shipping, hosting, analytics, marketing, data enrichment, fraud prevention, and customer support.
• Advertising and Data Partners: Information—including identifiers, device information, and browsing data—may be disclosed to or collected by third-party advertising and data partners through Tracking Technologies. These activities may constitute a “sale” or “sharing” under the California Consumer Privacy Act (“CCPA”). See Section 8 for opt-out rights.
• Legal and Safety: Information may be disclosed where we believe it necessary to comply with law, enforce our policies, protect rights or safety, or respond to legal process.
• Corporate Transactions: Information may be disclosed in connection with a merger, acquisition, sale of assets, or similar transaction.
5. Monitoring of Services and Communications
By using the Services, you acknowledge and consent that all interactions with the Services—including browsing activity, communications through customer support or inquiry features, and all other use of the Services—may be monitored, recorded, and analyzed by MaviGadget and its authorized service providers for purposes including providing and improving the Services, quality assurance, fraud prevention, security, and any other lawful purpose. Third-party service providers may assist with this monitoring using Tracking Technologies and other tools. Your use of any feature of the Services constitutes consent to the participation of such service providers in the monitoring and processing of your interactions, to the fullest extent permitted by applicable law.
6. Marketplace Platform; Seller Responsibilities
MaviGadget is a technology platform. MaviGadget does not manufacture, sell, distribute, warehouse, or ship any product listed on the marketplace unless expressly stated otherwise. All product-related content on the Services—including listings, descriptions, images, pricing information (including any reference, comparative, original, or suggested retail prices), specifications, availability, promotions, warranties, and claims—is provided solely by the applicable Seller. MaviGadget does not create, verify, endorse, or guarantee any Seller-provided content.
When you complete a transaction through the marketplace, the Seller—not MaviGadget—is the merchant of record and the party responsible for the product, its description, its pricing, its quality, its compliance with applicable laws, and any claims or representations made about it.
Seller Data Obligations. Under our Seller Agreement, each Seller independently agrees to: (a) act as an independent data controller (or equivalent under applicable law) for any personal information received through the marketplace; (b) maintain and comply with their own privacy policy that meets all requirements of applicable law; (c) use buyer personal information strictly and solely for order fulfillment, shipping, and directly related customer service; (d) not sell, rent, lease, license, share, or otherwise repurpose buyer personal information for marketing, advertising, profiling, data enrichment, or any other purpose unrelated to the specific transaction; (e) implement reasonable administrative, technical, and physical safeguards to protect buyer personal information; (f) respond to data subject rights requests directed to them; (g) notify MaviGadget promptly of any data breach or unauthorized access involving buyer personal information; (h) comply with all applicable privacy, data protection, consumer protection, advertising, and marketing laws; and (i) indemnify and hold harmless MaviGadget from any claims, losses, damages, or liabilities arising from the Seller’s data handling practices, content, products, pricing representations, or violations of applicable law.
MaviGadget reserves the right to audit, suspend, restrict, or permanently terminate any Seller that violates these obligations. However, MaviGadget cannot monitor or guarantee every Seller’s compliance in real time. Each Seller is independently and solely responsible for its own legal compliance. This Privacy Policy does not govern the practices of any Seller, and MaviGadget is not liable for any Seller’s collection, use, disclosure, retention, security, or other handling of personal information. If you have a concern about a Seller’s practices, we encourage you to review the Seller’s own privacy policy and to contact us at privacy@mavigadget.com so we may investigate.
7. Cookies and Your Choices
The Services use Tracking Technologies organized into the following categories, which correspond to the preference controls available on our website:
Required. Technologies necessary for the Services to function, including authentication, cart persistence, checkout, and security. These are set by MaviGadget and by our underlying e-commerce platform infrastructure provider and cannot be disabled.
Personalization. Technologies that remember your preferences and customize your experience on subsequent visits.
Marketing. Technologies used for advertising, remarketing, audience building, and data enrichment purposes. This category includes technologies used by third-party data partners to associate browsing activity or device identifiers with contact information maintained in their databases. These activities may constitute a “sale” or “sharing” under applicable law. If you disable this category, these data partner technologies will not operate on your session.
Analytics. Technologies that help us understand how visitors use the Services and identify areas for improvement. If you disable this category, behavioral analytics will not be collected for your session.
When you first visit the Services, a preference panel allows you to accept all, decline all, or selectively enable or disable each non-essential category. You may update your preferences at any time through the “Cookie Preferences” link in the website footer, through your browser settings, or by enabling Global Privacy Control (GPC).
8. Do Not Sell or Share; Opt-Out Rights
Certain activities described in this Policy may constitute a “sale” or “sharing” of personal information, or “targeted advertising,” under the CCPA or similar state laws. You may opt out by:
• Clicking the “Do Not Sell or Share My Personal Information” link in the website footer.
• Disabling the Marketing category in the Cookie Preferences panel.
• Emailing privacy@mavigadget.com with the subject line “Opt-Out Request.”
• Enabling Global Privacy Control (GPC) in your browser.
• Using the unsubscribe link included in any marketing email from MaviGadget.
When you opt out, we will take commercially reasonable steps to cease the applicable activities and to direct our third-party partners to suppress your information from further processing for those purposes. Opt-out requests may take up to 15 business days to be fully effectuated. Opting out will not affect processing necessary for transactions, service operation, or legal compliance.
9. Your Privacy Rights
Depending on where you reside, applicable law may give you rights regarding your personal information, such as rights to access, correct, delete, port, or opt out of certain processing. To exercise any applicable right, contact privacy@mavigadget.com. We will verify your identity and respond within the timeframes required by law. We do not discriminate against individuals who exercise their privacy rights.
10. Categories of Personal Information (California)
In the preceding 12 months, we may have collected, disclosed for a business purpose, or sold/shared the following categories of personal information as defined under the CCPA: identifiers; customer records information; commercial information; internet or other electronic network activity information; geolocation data (approximate); audio, electronic, or visual information; professional or employment-related information (from Sellers); and inferences. Sources, purposes, and recipients for each category are generally as described in Sections 2, 3, and 4 of this Policy. We do not knowingly collect sensitive personal information for purposes beyond those permitted by law.
11. Data Retention
We retain personal information for as long as reasonably necessary to fulfill the purposes for which it was collected, provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements.
12. Security
We implement reasonable administrative, technical, and physical safeguards designed to protect personal information. No system is completely secure, and we cannot guarantee absolute security.
13. Children’s Privacy
The Services are not directed to individuals under 13. We do not knowingly collect personal information from children. If you believe a child has provided information to us, contact privacy@mavigadget.com.
14. International Transfers
Your information may be transferred to and processed in the United States or other jurisdictions. Where required by law, we rely on appropriate transfer mechanisms.
15. Third-Party Links
The Services may contain links to third-party websites or services. We are not responsible for their privacy practices.
16. Disputes
Any dispute arising from this Policy is subject to the dispute resolution provisions in our Terms of Service, which are incorporated by reference. In the event of a conflict between this Policy and the Terms of Service regarding personal information, the more privacy-protective provision controls.
17. Changes to This Policy
We may update this Policy from time to time. When we do, we will revise the “Last Updated” date above. For material changes, we may provide additional notice. Your continued use of the Services after changes constitutes acceptance.
