This marketplace is operated by Brandimi LLC. Throughout the site, the terms “we”, “us” and “our” refer to MaviGadget. MaviGadget offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, brands, and/ or contributors of content.

 SECTION 2 – ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. SECTION 3 – VENDOR ELIGIBILITY In order to become a vendor on MaviGadget, you must meet the following eligibility requirements: a. You must be at least 18 years old or the legal age of majority in your jurisdiction. b. You must have a valid email address and agree to receive communications from MaviGadget. c. You must have a valid bank account or other payment method that is accepted by MaviGadget. d. You must not have a history of fraudulent or abusive behavior on online marketplaces. e. You must provide accurate and complete information during the vendor registration process.
MaviGadget reserves the right to reject any vendor application or terminate any vendor account that violates our policies or eligibility criteria. We may also require additional verification or documentation from vendors, such as government-issued identification, social security number, passport, or any other documents that we deem necessary.

SECTION 4 – PAYMENTS MaviGadget offers various payment methods to vendors, including bank account transfers, PayPal, cash, Western Union, MoneyGram, TransferWise, and any other payment method available in your country. You must provide accurate and complete payment information to receive payouts. We may hold payouts up to $35,000 for unverified vendors in order to prevent fraudulent activities. To become a verified vendor, you may be required to provide personal identification documents, such as a government-issued ID, social security number, passport, or any other verification documents that we deem necessary. If you fail to complete the verification process, we may continue to hold payouts until the verification is completed. We will process payouts to your preferred payment method on every 3 months for completed orders unless otherwise agreed . However, in certain circumstances, such as a customer dispute or return, we may withhold the payment until the issue is resolved. We reserve the right to deduct any fees or charges from your payout, such as platform fees, payment processing fees, or chargeback fees.

SECTION 5- Product Removal Policy

MaviGadget reserves the right to refuse the addition of any product or remove products from our platform without prior notice. We may remove products that violate our policies, including but not limited to prohibited products, products with intellectual property rights violations, or products that do not meet our quality standards.

SECTION 6- Payout Hold for Dispute Resolution

In the event of a dispute or confusion regarding an order or product, we may hold the payout until the issue is resolved. We may also withhold payouts in the case of suspected fraudulent activity or violation of our policies.

SECTION 7- Prohibited Products

As a vendor on MaviGadget, you are prohibited from selling any illegal or unauthorized products, including but not limited to counterfeit goods, products that violate intellectual property rights, or products that promote hate or violence. We reserve the right to remove any prohibited products from our platform and terminate your vendor account.

SECTION 8- DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.
We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.
You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.
You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall MaviGadget, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. SECTION11- Intellectual Property Rights

MaviGadget respects the intellectual property rights of others and expects our vendors to do the same. You are prohibited from selling any products that infringe upon the intellectual property rights of others, including but not limited to copyrights, trademarks, and patents.

If we receive a valid complaint from a rights holder alleging that your product infringes upon their intellectual property rights, we may remove the product from our platform and terminate your vendor account. We may also require you to provide proof of ownership or licensing of any intellectual property associated with your products.

SECTION12- Feedback Policy

MaviGadget encourages buyers to provide feedback on their purchases and experiences with vendors. However, we do not tolerate fake or misleading feedback, such as the creation of multiple accounts to leave positive feedback or the offering of incentives in exchange for feedback.

We reserve the right to remove any feedback that violates our policies and may terminate the accounts of vendors who engage in fraudulent feedback practices.

SECTION13- Termination of Vendor Account

MaviGadget reserves the right to terminate your vendor account at any time, with or without cause. We may terminate your account if you violate our policies or engage in fraudulent or abusive behavior on our platform. We may also terminate your account if we believe that your products or services do not meet our quality standards or are not in the best interests of our users.

Upon termination of your account, you must immediately cease using our platform and remove all of your products and content from our platform. We may also withhold any unpaid payouts or fees owed to you.

SECTION14- Communications

By using our platform, you agree to receive communications from MaviGadget, including but not limited to emails, newsletters, and notifications. You may opt-out of certain types of communications, such as marketing emails, by adjusting your communication preferences in your account settings.

SECTION15-Prohibited Activities

As a vendor on MaviGadget, you are prohibited from engaging in any activities that violate our policies or applicable laws, including but not limited to:

  • Posting false or misleading information about your products or services.
  • Engaging in price-fixing or collusion with other vendors.
  • Engaging in unfair or deceptive practices, such as bait-and-switch tactics or misleading advertising.
  • Using automated tools or bots to manipulate our platform or engage in fraudulent activities.
  • Engaging in any activities that violate the intellectual property rights of others.

We reserve the right to investigate and take action against any vendors who engage in prohibited activities on our platform, including termination of their vendor account and reporting to law enforcement authorities.

SECTION16- Seller Responsibility

As a vendor on MaviGadget, you are solely responsible for the accuracy, quality, and legality of your products and services. You are also responsible for complying with all applicable laws, regulations, and industry standards related to your products and services.

MaviGadget is not responsible for any claims, damages, liabilities, or expenses arising out of your products or services, including but not limited to product defects, injuries, or illnesses. You agree to indemnify and hold harmless MaviGadget and its officers, directors, employees, and agents from any claims arising out of your products or services.

We reserve the right to update or modify these Vendor Terms of Policy at any time, without prior notice to you. It is your responsibility to review these policies periodically for any changes. Your continued use of our platform after any changes to these policies will constitute your acceptance of the revised policies.

SECTION17- Agency Relationship

MaviGadget and its vendors are independent contractors and do not have an agency, partnership, or joint venture relationship. You are solely responsible for your own actions and decisions related to your use of our platform and your products or services.

SECTION18- Force Majeure

MaviGadget shall not be liable for any failure or delay in performance of its obligations under these policies due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, or government regulations.

MaviGadget offers phone support to assist vendors with setting up their accounts and answering any questions they may have about our platform. If you choose to receive phone support, you agree to the following terms:

a. You agree to provide accurate and complete information over the phone, including your name, email address, and other personal or business information as needed.

b. You agree to comply with these Vendor Terms of Policy and any other policies or guidelines provided to you during the phone support call.

c. You understand that MaviGadget may record or monitor phone calls for quality control or training purposes.

d. You acknowledge that any agreements or terms discussed over the phone are binding and enforceable, and that you are responsible for complying with them.

If you choose to receive phone support, you may be required to provide additional verification or documentation to confirm your identity or eligibility as a vendor. MaviGadget reserves the right to refuse phone support or terminate phone support for any vendor who violates our policies or engages in abusive or fraudulent behavior on our platform.

SECTION20- Advertising Packages

MaviGadget offers advertisement packages to help vendors promote their products or services on our platform and through other marketing channels, such as social media, email, or paid search. Advertisement packages may include features such as sponsored product listings, banner ads, or targeted email campaigns.

If you choose to purchase an advertisement package, you agree to the following terms:

a. Payment: You agree to pay the full price of the advertisement package at the time of purchase. Payment may be made through our payment processing partners, such as PayPal or Stripe.

b. Product or Service Information: You agree to provide accurate and complete information about your products or services, including product descriptions, images, and other content as needed. You understand that the accuracy and quality of your product or service information may affect the effectiveness of your advertisement package.

c. Availability: You acknowledge that advertisement packages are subject to availability and may be modified or discontinued at any time without prior notice. We will make reasonable efforts to inform you of any changes or updates to your advertisement package.

d. Use of Information: You understand that MaviGadget may use your product or service information to create advertisements or promotional content on our platform or other marketing channels. You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute your product or service information for the purposes of promoting your products or services.

e. Non-Refundable and Non-Transferable: You acknowledge that advertisement packages are non-refundable and non-transferable. If you choose to cancel your advertisement package or terminate your vendor account before the end of the advertisement period, you will not be entitled to a refund or credit.

In addition, MaviGadget assumes that any products or content featured on our platform, including those featured through advertising packages, are legal and do not infringe upon the intellectual property rights of others. As a vendor on our platform, you are responsible for ensuring that your products and content comply with all applicable laws, regulations, and industry standards.

MaviGadget reserves the right to remove any products or content from our platform that we believe may violate our policies or infringe upon the intellectual property rights of others. If we receive a valid complaint from a rights holder alleging that your product infringes upon their intellectual property rights, we may remove the product from our platform and terminate your vendor account. We may also require you to provide proof of ownership or licensing of any intellectual property associated with your products.
